## Terms and Conditions for Hizaps

Welcome to Hizaps! These Terms and Conditions ("Terms") govern your access to and use of the Hizaps web application and chatbot services (the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

**1. Acceptance of Terms**

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

**2. Description of Services**

Hizaps provides a web application that offers chatbot services, enabling our clients to capture leads and facilitate chat communication on their websites. The Services are provided on an "as is" and "as available" basis.

**3. Your Responsibilities**

When using our Services, you agree to:

* **Provide Accurate Information:** If you create an account, you agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.

**5. Disclaimer of Warranties**

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. HIZAPS SPECIFICALLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. HIZAPS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. HIZAPS DOES NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

**HIZAPS IS NOT RESPONSIBLE FOR ANY DAMAGES WHATSOEVER RESULTING FROM THE USE OF THE SERVICES.**

**6. Limitation of Liability**

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HIZAPS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT HIZAPS HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

**7. Indemnification**

You agree to indemnify, defend, and hold harmless Hizaps, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:
* Your use of or reliance on the Services.
* Your violation of these Terms.
* Your violation of any rights of another, including but not limited to intellectual property rights or privacy rights.
* Any content you submit, post, transmit, or make available through the Services.

**8. Modifications to Terms**

Hizaps reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.

**9. Governing Law**

These Terms shall be governed and construed in accordance with the laws of India, specifically within the jurisdiction of the courts in Bangalore.

**10. Severability**

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hizaps regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
